Four actions in the district court for Ramsey county, one on behalf of Richard F. Dehn by his father and natural guardian for personal injuries sustained when the son fell into a fire on the premises of defendant S. Brand Coal & Oil Company; one on behalf of James C. Lachowitzer by his father and natural guardian for similar injuries; and the others by said fathers in their own behalf for consequential damages. In all actions the city of St. Paul, former lessee of the property, was joined as additional defendant. The cases were tried before Albin S. Pearson, Judge, and a jury which returned verdicts of $5,125 for Richard F. Dehn, $1,400 for Richard R. Dehn, $2,400 for James C. Lachowitzer, and $1,300 for George P. Lachowitzer, and a special verdict that the additional defendant was negligent. Defendants jointly and severally appealed from an order denying defendant citys alternative motion for judgment or a new trial and defendant coal companys alternative motion for judgment, a new trial, or judgment against the defendant city.
